General Terms and Conditions

for GlowCast, a brand of Andorfer Webdesign. Last updated: October 2026

This English version is a non-binding translation provided for your convenience. Only the German version is legally binding.

§ 1 Scope

(1) These terms apply to all contracts between Andorfer Webdesign, owner Andre Andorfer, Mozartstr. 11, 94060 Pocking, Germany (hereinafter “we”) and you (hereinafter “customer”) concerning

  • the GlowCast Premium license (unlocking the GlowCast software with a license key) and
  • the Custom Design (individual setup of GlowCast and channel graphics according to the customer’s specifications).

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 BGB, German Civil Code). An entrepreneur is anyone who, when concluding the contract, acts in the exercise of their trade, business or self-employed profession (Section 14 BGB). Streamers who run their channel commercially act as entrepreneurs.

(3) Deviating terms of the customer only apply if we expressly agree to them in text form.

§ 2 Free use (GlowCast Basic)

We provide GlowCast Basic free of charge and without any entitlement to a particular range of functions. We are only liable for it in cases of intent and gross negligence and for fraudulently concealed defects. The “design of the month” is a voluntary offer that changes monthly.

§ 3 Conclusion of the contract

(1) The presentation of GlowCast Premium and Custom Design on our website is not a binding offer but an invitation to place an order.

(2) The customer orders by email to kollaboration@andorfer-webdesign.de or via an ordering channel stated on the website. The contract is concluded when we accept the order in text form (usually by email). The confirmation contains the content of the contract, the price, these terms and the withdrawal policy.

(3) The contract can be concluded in German or English. English versions of these terms, the withdrawal policy and our correspondence are translations; in case of any discrepancy, the German version prevails. We store the text of the contract and send it to the customer with the confirmation, in both languages for contracts concluded in English.

§ 4 Services

GlowCast Premium

(1) The customer receives a license key that unlocks the Premium features in GlowCast as described on the website at the time of the order. The license is not limited in time. We provide GlowCast updates within the scope of the statutory obligation to update digital products (Section 327f BGB); beyond that, we develop GlowCast further at our own discretion.

(2) Use requires a PC with Windows 10 or 11 and OBS Studio. Features that use third-party services (e.g. Twitch, YouTube, Kick, TikTok via TikFinity or Streamer.bot) depend on their availability, interfaces and terms, over which we have no influence. Certain Twitch features (channel points, Hype Train, polls, predictions) require an Affiliate or Partner channel.

Custom Design

(3) Based on the customer’s specifications, we create an individual branding package for GlowCast: color values matching the logo, text for scenes, ticker and offline schedule, sounds and images for alerts as well as channel graphics (Twitch panels, profile banner, offline image, profile picture, YouTube banner) and setup instructions. The exact scope is set out in our order confirmation.

(4) The price includes one round of revisions after the first draft. We carry out further changes by prior arrangement for a separate fee.

(5) Using the Custom Design in GlowCast requires a Premium license, because custom colors and custom alerts are Premium features. The license is not included in the price of the Custom Design unless it was expressly ordered as well.

§ 5 Customer cooperation (Custom Design)

(1) The customer provides us in good time with the materials needed for the Custom Design, in particular their logo, the link to their channel and their wishes.

(2) The customer warrants that they hold the necessary rights to the content provided (e.g. logo, images, names) and that its use does not infringe any third-party rights. The customer indemnifies us against third-party claims based on a breach of this obligation, insofar as the customer is responsible for the breach.

(3) If delivery is delayed because materials are missing, agreed dates are postponed accordingly.

§ 6 Prices and payment

(1) The prices at the time of the order apply. All prices are final prices including statutory VAT.

(2) Payment is due in advance. We state the payment method and payment details in the order confirmation. We send the license key after receipt of payment; we start work on the Custom Design after receipt of payment.

§ 7 Delivery

(1) We deliver the license key and the Custom Design files by email or as a download link.

(2) We agree the delivery date for the Custom Design with the customer in the order confirmation.

§ 8 Rights of use

(1) GlowCast Premium: The customer receives a simple (non-exclusive), non-transferable right, unlimited in time, to use GlowCast with their license key for their own streams and to install it on their own computers for this purpose. Passing on, selling or publishing the license key is not permitted. We may block a key that has demonstrably been passed on or published.

(2) Custom Design: Upon full payment, the customer receives a simple (non-exclusive) right, unlimited in time and territory, to use the graphics, texts and media created for them for their own channels and streams, including to promote their channel. Use is not permitted before full payment. Editable working files remain with us unless otherwise agreed. Content provided by the customer remains the customer’s property.

(3) We may show the Custom Design as a reference (e.g. on our website) unless the customer objects.

§ 9 Warranty

(1) The statutory rights in respect of defects apply, for digital products in particular Sections 327 et seq. BGB. For entrepreneurs, the limitation period for claims for defects is 12 months from delivery; this does not apply to claims for damages under § 10.

(2) According to the state of the art, software cannot be completely free of errors in every environment. A defect exists if GlowCast does not perform the described functions under the stated requirements.

§ 10 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and insofar as we have given a guarantee.

(2) In cases of slight negligence, we are only liable for breach of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely, and then limited to the foreseeable damage typical for this type of contract.

(3) We are not responsible for the availability of third-party services (Twitch, YouTube, Kick, TikTok, OBS Studio) or for content that the customer displays via GlowCast.

§ 11 Right of withdrawal

Consumers have a statutory right of withdrawal. Details, in particular on its early expiry for digital content and services, are set out in the withdrawal policy. Entrepreneurs have no right of withdrawal.

§ 12 Data protection

How we handle personal data is set out in the privacy policy.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is our place of business in Pocking.

(3) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG, German Consumer Dispute Resolution Act).

(4) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provision.
